Revolution Rail Company, LLC is committed to protecting the privacy of our riders. “Revolution Rail,” “we,” “our” and “us” refers to Revolution Rail Company, LLC and each of its subsidiaries, affiliates and related entities.

1.         Scope.

This Privacy Policy covers the information Revolution Rail Co. collects about you when you use our Services. For purposes of this Privacy Policy, the “Services” mean: (a) the website located at www.revrail.com (the “Website”); (b) the organized rail biking tours and related travel experiences, including but not limited to any associated trip planning, waivers, reservations, and support services provided by us in connection with such tours (the “Trips”); (c) any customer support, correspondence, or communications we provide in connection with the foregoing; (d) marketing communications; and (e) any other products, tools or services we may offer from time to time.

2.         Information We Collect.

In connection with the Services, we may collect the following categories of personal information: contact information (such as name, address, email, and phone number); reservation details; billing information; emergency contact information; waiver information; survey responses; marketing preferences; social media interactions; device information; IP addresses; cookies; browser information; and website usage data.

3.         How We Use Information.

We use the information we collect to process and manage reservations; verify waivers and eligibility to participate in a Trip; communicate with you about rides and related logistics; respond to questions and customer service requests; administer surveys and request reviews; and improve our operations. We may also use this information to satisfy any legal, accounting, or reporting requirements.

In addition, we may use the information to send marketing communications, including newsletters, announcements of new locations or events, seasonal promotions, loyalty offers, and other promotional content. You may unsubscribe from marketing communications at any time.

4.         Cookies, Analytics & Advertising.

We use cookies and similar technologies, including Google Analytics, Meta Pixel, and comparable analytics or advertising tools, to understand website usage, improve performance, measure advertising effectiveness, personalize content, and improve the rider experience.

5.         Third-Party Service Providers.

We share information we collect with trusted third-party service providers who perform functions on our behalf, including reservation management, payment processing, electronic waiver administration, website hosting, analytics, email delivery, advertising, customer support, and other operational services. We provide these service providers with only the information reasonably necessary to perform their designated functions.

6.         Data Retention.

We collect and retain only the information reasonably necessary to provide the Services and comply with our legal, safety, and business obligations.

7.         Children's Privacy.

The Services are not directed to children, and we do not knowingly collect personal information directly from children under the age of 13. If we become aware that we have collected personal information directly from a child under the age of 13, we will delete that information as soon as possible.

In connection with booking a reservation, a parent or legal guardian may voluntarily provide us with information about a child, such as the child's name, age, and other details necessary for booking a Trip. We collect and use such information solely for purposes of processing the reservation and providing the Services.

8.         Data Security.

We use reasonable administrative, technical, and physical safeguards designed to protect personal information from unauthorized access or use. However, no system is completely secure. While we work to protect the personal information we hold, we cannot guarantee its absolute security, and you provide information to us at your own risk. If we become aware of a security incident affecting your personal information, we will notify you and take other steps as required by applicable law.

9.         Do Not Track Signals.

Some web browsers may transmit “Do Not Track” (“DNT”) signals to websites and online services with which the user communicates. Because there does not yet encumber a common industry or legal standard for interpreting DNT signals, our website does not currently change its tracking practices or respond to DNT streams or headers received from web browsers. Instead, you can manage your cookie preferences directly through your browser settings or via the cookie controls provided on our site.

10.       European Economic Area Residents.

While Revolution Rail is based in the United States and primarily serves customers in the United States, we occasionally provide services to individuals located in the European Economic Area (the “EEA”).  If you are an individual in EEA, we collect and process information about you only where we have legal bases for doing so under applicable EU laws. The legal bases depend on the Services you use and how you use them. This means we collect and use your information only where:

  • We need it to provide you the Services, including to operate the Services, provide customer support and personalized features and to protect the safety and security of the Services;

  • It satisfies a legitimate interest (which is not overridden by your data protection interests): (a) for research and development; (b) to market and promote the Services; or (c) to protect our legal rights and interests;

  • You give us consent to do so for a specific purpose; or

  • We need to process your data to comply with a legal obligation.

If you have consented to our use of information about you for a specific purpose, you have the right to change your mind at any time, but this will not affect any processing that has already taken place. Where we are using your information because we or a third party have a legitimate interest to do so, you have the right to object to that use though, in some cases, this may mean no longer using the Services.

If you are located in the EEA, you have the right to:

  • Access the personal data we hold about you;

  • Correct inaccurate or incomplete data;

  • Request deletion of your data;

  • Restrict or object to certain processing;

  • Request a copy of your data in a portable format; and

  • Withdraw consent at any time, where processing is based on consent.

To exercise any of these rights, please contact us at info@revrail.com.  We will respond to your request within the timeframes required by applicable law.

11.       Cross-Border Information Transfers.

You acknowledge: (a) that you are accessing a Website that is based in the United States; (b) that you are providing personal information to a company in the United States; and (c) that Revolution Rail must adhere to laws of the United States. You agree that personal information collected on our Website may be stored and processed in the United States or any other country in which Revolution Rail, its affiliates, partners, service providers, or agents maintain facilities, and while in such jurisdictions may be subject to access pursuant to the laws of those jurisdictions.

Each of these countries has different privacy laws that afford varying levels of protection for your personal information, and such laws may be less stringent or may not be as comprehensive as those laws that exist in your country. However, in all instances Revolution Rail will ensure that such information is subject to the standards articulated in this Privacy Policy, including compliance with the EU-U.S. Data Privacy Framework (and the UK Extension to the EU-U.S. Data Privacy Framework) Principles below.
